Introduction

Red Tree Real Estate (together with any affiliated or subsidiary entities, “we,” “our,” or “us”) respects your privacy and is committed to protecting it through this Privacy Policy.

This Privacy Policy describes the types of information we may collect from you, or that you may provide, when you access or use our website(s) (the “Website”) and any related services, tools, search features, IDX property search, forms, and communications (collectively with the Website, the “Services”). Our Services are intended for U.S. residents.

This policy applies to information we collect related to: (1) the Services, (2) emails, texts, and other electronic messages between you and us, (3) your interaction with our advertising on third party websites and services if the advertising links to this policy, and (4) current, former, and prospective clients, customers, tenants, landlords, buyers, sellers, and other individuals who communicate or interact with us in connection with our real estate business.

This Privacy Policy does not apply to information collected by: (a) us offline or through any other means outside the Services, or (b) any third party, including through any application or content (including advertising) that may link to or be accessible from the Services.

By accessing or using the Services, you agree to this Privacy Policy. If you do not agree, do not use the Services. We may update this policy from time to time as described under “Changes to This Privacy Policy.”

Children Under 13

Our Services are not intended for children under 13 years of age, and we do not knowingly collect personal information from children under 13. If you are under 13, do not use the Services or provide any information through the Services. If we learn we have collected personal information from a child under 13, we will delete it. If you believe we might have information from or about a child under 13, contact us using the information in the “Contact Information” section.

Information We Collect and How We Collect It

We collect several types of information from and about users of the Services, including:

  1. Personal information. Information by which you may be identified or contacted, such as name, mailing address, email address, telephone number, and information you include in messages or forms submitted to us.
  2. Real estate related information. Information about your property searches, preferences, buying or selling intentions, rental needs, home criteria, appointment requests, and other details connected to a real estate transaction. This may include information about financing preferences you choose to share.
  3. Device and usage information. Information about your internet connection, device, and how you use the Services, such as IP address, browser type, operating system, pages viewed, referring pages, and interaction patterns.

We collect this information:

A) Directly from you. When you fill out forms, request information, schedule a showing, create an account (if applicable), sign up for updates, submit a message, or otherwise communicate with us.

B) Automatically. As you navigate the Services, we may automatically collect usage and device information using cookies and similar technologies.

C) From third parties. We may receive information from third party sources such as public records (including property ownership and tax records), marketing partners, social media platforms if you choose to connect with them, or other sources that help us provide the Services.

Cookies, Analytics, and Similar Technologies

We use cookies and similar technologies (for example, pixels and tags) to operate the Services, understand usage, improve performance, and measure marketing effectiveness.

Cookies. Cookies are small files stored by your browser. They help with core site functions and may remember preferences. You can set your browser to refuse some or all cookies or to alert you when cookies are being set. If you disable cookies, parts of the Services may not function properly.

Pixels and similar tools. Pages and emails may contain small files that let us measure engagement (for example, whether an email was opened or a page was viewed).

Analytics. We may use analytics tools such as Google Analytics to better understand how visitors use the Services. Google provides a browser add on designed to opt out of Google Analytics measurement in supported browsers.

Interest-based advertising and opt-outs. Some third parties that help deliver ads or measure campaigns may provide opt out tools. The Network Advertising Initiative (NAI) provides information and tools for opting out of certain interest based advertising by participating companies.

Third-Party Tracking on Our Services

Some content or applications on the Services may be served by third parties (for example, embedded tools, analytics providers, or advertising networks). Those third parties may use cookies or similar tools to collect information about you across websites over time. We do not control these third parties’ technologies or practices. For questions about a specific third party’s practices, you should review that third party’s privacy policy.

How We Use Your Information

We use information we collect to:

Provide the Services. To present the Website and its content, respond to inquiries, schedule showings, deliver requested resources, and provide real estate services.

Communicate with you. To send confirmations, service messages, updates you request, and other communications related to your interactions with us.

Personalize and improve. To understand usage, improve site performance, tailor content, and make the Services more relevant to your preferences.

Marketing and advertising. To send you our own communications about services that may be relevant to you, and to measure and improve advertising effectiveness. We do not share your personal information with third parties for their own direct marketing purposes without your consent.

Security and compliance. To protect the Services, prevent fraud, enforce our agreements, comply with legal obligations, and respond to lawful requests.

Disclosure of Your Information

We may disclose information as follows:

Service providers. To contractors and vendors that support our business operations (such as hosting, analytics, scheduling, email delivery, CRM systems, and professional advisors) who are obligated to handle information appropriately.

Real estate transaction support. To parties involved in a transaction at your direction or as reasonably necessary to provide requested services (for example, cooperating brokers or agents, transaction coordinators, inspectors, or closing related parties), consistent with your requests and applicable law.

Legal and safety reasons. To comply with court orders, subpoenas, or lawful governmental requests, and to protect the rights, property, or safety of Red Tree, our clients, and others.

Business transfers. If we are involved in a merger, acquisition, reorganization, or sale of assets, information may be transferred as part of that transaction.

We may also disclose aggregated or de-identified information that does not identify you, without restriction.

Your Choices

You have choices about how your information is used:

Cookies and tracking controls. You can control cookies through your browser settings. Disabling cookies may impact functionality.

Marketing emails. You can unsubscribe from marketing emails using the link in the email, or you can contact us. Even if you opt out of marketing messages, we may still send you service-related messages (for example, responding to an inquiry).

Targeted advertising choices. You may be able to opt out of certain interest-based advertising through industry tools such as those provided by the NAI.

Accessing and Correcting Your Information

If the Services offer an account profile, you may be able to review and update certain information through your profile. You may also contact us to request access to, correction of, or deletion of certain personal information you have provided to us. In some cases, we may need to retain information for legal, regulatory, or operational reasons.

State Privacy Rights

Depending on where you live, you may have additional rights under state privacy laws, which can include the right to request access, deletion, correction, and data portability, and to opt out of certain processing, such as targeted advertising.

A number of states have enacted comprehensive consumer privacy laws, and additional state laws continue to take effect over time. If you wish to exercise applicable rights, please email us using the contact information below with the subject line “Privacy Request.” We may need to verify your identity before processing your request.

Massachusetts note. Massachusetts privacy legislation has been proposed and debated, and the legal landscape may evolve. We will update our practices and this policy as required by applicable law.

Data Security

We use reasonable administrative, technical, and physical safeguards designed to protect personal information. However, no system is perfectly secure. Any transmission of information through the internet is at your own risk. If you create or receive login credentials, you are responsible for maintaining their confidentiality.

Data Retention

We retain personal information for as long as reasonably necessary to provide the Services, maintain records, resolve disputes, enforce agreements, and comply with legal obligations. Retention periods vary depending on the type of information and the purpose for which it was collected.

Third Party Websites

The Services may contain links to third-party websites or services. We do not control those third parties, and this Privacy Policy does not apply to them. Review the privacy policies of any third-party sites you visit.

Changes to This Privacy Policy

We may update this Privacy Policy from time to time. If we make material changes, we will post a notice on the Website. The “Last modified” date at the top indicates when this policy was last updated. You are responsible for reviewing this policy periodically.
